Success - Out-of-State Commercial Driver Off the Hook

  
  
  

CDLAn out-of-state client of ours was a professional trucker (a Commercial Driver’s License holder) who hit a telephone poll while avoiding a rouge motorist in Aberdeen Township. The telephone poll crashed to the ground creating a substantial amount of damage. Our client had been cited for careless driving, a substantial mar on a trucker's driving record. As a trucker, a conviction of careless driving made losing his job a significant possibility. Worse still, because he was an out-of-state resident, he was not able to amend his charge to a standard ordinance. Though the chips were clearly stacked against our client, I was able to argue the citation down to a lesser offense by referring the prosecutor to a statute with which he himself was not familiar. The statute itself did not even provide a fine! By understanding and applying the minute details of the law, we were able to spare our client the horror of losing his only source of income, and, in this economy, nothing could have made our client happier.
