NJ Divorce 101: Why Filing the Complaint Matters More Than You Think

Written by John Malchow, Esq. | Dec 2 2025

Making the decision to end a marriage is never easy. Fortunately, starting the formal divorce process in New Jersey is more straightforward than most people expect. Every divorce case begins with filing a Complaint for Divorce in the Superior Court. Once the complaint is docketed, it must be properly served on the other spouse (the Defendant), who then has 35 days to file a response.

If the Defendant does not respond within that timeframe, the court may enter a default judgment, allowing the divorce to move forward much more quickly—sometimes far faster than anticipated.

Whether you are preparing to file for divorce or have recently been served with a complaint, Simon Law Group’s experienced Family Law Attorneys are here to guide you. Contact us today to discuss your circumstances and learn how we can help you navigate the process with clarity and confidence.
