NJ Divorce 101: Why Filing the Complaint Matters More Than You Think

Making the decision to end a marriage is never easy. Fortunately, starting the formal divorce process in New Jersey is more straightforward than most people expect. Every divorce case begins with filing a Complaint for Divorce in the Superior Court. Once the complaint is docketed, it must be properly served on the other spouse (the Defendant), who then has 35 days to file a response.

If the Defendant does not respond within that timeframe, the court may enter a default judgment, allowing the divorce to move forward much more quickly—sometimes far faster than anticipated.
