Effective Date: 2026-05-04
1. About this Notice
This Notice explains how Simon Law Group, LLC ("SLG") sends messages by SMS and iMessage and how you can control those messages, in compliance with the Telephone Consumer Protection Act ("TCPA") (47 U.S.C. § 227), Federal Communications Commission rules, the CTIA Messaging Principles & Best Practices, and applicable state law.
We send messages through SendBlue, our messaging service provider. Depending on your device and carrier, messages may be delivered as SMS or iMessage.
2. Programs
We operate the following messaging programs:
| Program | Purpose | Frequency |
|---|---|---|
| Case Updates | Status updates on your matter, document requests, court-date notices | As needed |
| Appointment Reminders | Confirmations and reminders for meetings, depositions, court dates | At scheduling and 24-48 hours before |
| Payment & Trust Notices | Invoice, payment-confirmation, and trust-account-related notices | As needed |
| Account & Security | Security alerts, password resets, optional SMS multi-factor codes (TOTP authenticator app is the default; SMS MFA is opt-in only) | As needed |
Marketing, where applicable, is treated as a separate program with its own opt-in.
3. Express Consent
You provide express consent to receive messages from a particular program when you:
- check the program's consent box during intake or in your Portal settings; or
- request a service for which the messages are necessary.
Consent is not a condition of representation. SLG offers TOTP authenticator-app multi-factor authentication as the default; SMS MFA is opt-in only.
The following standard FCC-style disclosure applies to each program:
Msg & data rates may apply. Msg frequency varies. Reply HELP for help, STOP to cancel. Consent is not a condition of purchase or representation.

Message frequency varies based on your matter and program.
5. Cost
Message and data rates may apply depending on your carrier and plan. Apple iMessage delivered over Wi-Fi or cellular data is governed by your data plan.
6. Opt-Out
To stop messages, reply STOP to any message, or update your settings in the Portal. We will send a single confirmation message and no further messages from the program. You may continue to receive messages from any other program for which you remain opted in until you STOP each one.
7. Help
Reply HELP to any message for assistance, or contact info@simonattorneys.com · (800) 709-1131.
8. Privacy
Information collected through messaging is handled under our Privacy Policy. We do not sell phone numbers or message contents. SendBlue acts as our service provider under contract.
9. Carriers Not Liable
Carriers (including AT&T, T-Mobile, Verizon, and others) are not responsible for delayed or undelivered messages.
10. Sensitive Content
Do not send sensitive medical, financial, or legal information by SMS unless we have specifically asked for it through this channel. SMS is not encrypted end-to-end. iMessage between Apple devices is end-to-end encrypted by Apple, but we cannot guarantee delivery as iMessage in any specific case. For sensitive content, use the Portal.
11. Carrier and Number Information
We register our messaging traffic for A2P 10DLC where applicable and follow CTIA guidance. Numbers we use for messaging are listed on request.
11.1 Quiet Hours
Except for time-sensitive matter alerts (e.g., court-date reminders within 24 hours, urgent settlement communications), we will not send messages between 9:00 PM and 8:00 AM in your local time zone, consistent with TCPA quiet-hours expectations.
12. Changes
We may update this Notice. Material changes are governed by the Terms Change & Notice Policy.
