Avoiding the Courts where possible…

There are methods to almost entirely avoid court appearances during your divorce. By agreeing on the terms and conditions of your divorce upfront, the public may not learn about your assets, finances, or even the divorce itself.
You and your spouse may sign a Property or Marital Settlement Agreement (MSA or PSA) if you can settle all of your problems via attorney-assisted negotiation. The Agreement would include all of your agreements to settle your lawsuit. Couples sign and submit an MSA/PSA with the court. This Agreement would include everything from child custody and support to property division and other financial considerations. Ordinarily, one party writes the Agreement and the other examines it before signing it and ultimately filing it in court.


If you think you and your spouse can manage this with the help of an experienced divorce attorney, you can adequately ensure an uncontested divorce. If not, you might also consider Mediation or Arbitration. Mediation is voluntary and non-binding, whereas Arbitration is akin to a “private” court in which the final decisions are in fact binding on you and your spouse.

Reverse-Nuptials

Even if your spouse refuses to utilize less confrontational tactics, there are still ways to protect your privacy in divorce. For example, a post-nuptial agreement may handle divorce secrecy. A post-Nup may help prevent your spouse from exposing your divorce on Twitter, Instagram, Facebook, or TikTok, or speaking to News outlets and taking public interviews or adding commentary to outlets. Post-nuptial agreements are made during marriage and outline the parties' expectations. Violations may result in monetary penalties. A divorce agreement to limit social media posts on Facebook, Twitter, and other sites may safeguard your privacy.


Financial Record Sealing

If you must litigate the divorce due to a non-compliant spouse, we can request that the Court seals your financial records, but it’s an uphill battle and it’s ultimately left up to the judge. If someone can demonstrate that the public interest of open records outweighs your need for privacy, then documents will likely remain visible to the public, so any request to seal records need to be narrowly-tailored.
