Child Support


Child support is the amount of money that a parent must pay for their children, particularly following a divorce or separation between parents. It results from a formula found in the New Jersey Rules of Court and applies to both parents. It is based on their incomes as well as overnight parenting time with the child or children.

Child support is a right that actually belongs to the child although there is a common misconception that it belongs to the residential parent. Child support is purely paid for the benefit of the minor and should not be used for any other purpose if that purpose doesn't provide any direct net positive outcome for the child. A parent must generally pay Child support until the child is emancipated, either by petition or upon reaching adulthood.

This area of law involves certain additional considerations like health insurance, for example, in which the parent providing for (and thus paying for) the child's health insurance may in some cases be entitled to receive a credit for that financial expense.
