Public notice
How this notice applies
This page explains the website, portal, and online-tool terms that apply when you use Simon Law Group's public and client-facing digital services.
Effective Date: 2026-05-04
1. Why this matters
Simon Law Group, LLC ("SLG") uses artificial intelligence ("AI") to assist our staff and serve clients more efficiently. We believe in being transparent about how AI is used and about the limits of AI in legal practice. This Disclosure is consistent with the New Jersey Supreme Court's Notice to the Bar on the Use of Artificial Intelligence (January 25, 2024) and subsequent NJ Advisory Committee on Professional Ethics guidance on AI; ABA Formal Opinion 512 (July 2024) on generative AI; the Colorado AI Act; Utah's AI Disclosure Act; California SB 942 / AB 2013; the EU AI Act (where applicable); and our duties under RPC 1.1 (competence), RPC 1.4 (communication), RPC 1.6 (confidentiality), and RPC 5.3 (responsibilities regarding non-lawyer assistants — including AI tools).
2. Where we use AI
| Feature | What it does | Vendor |
|---|---|---|
| Voice AI assistant | Real-time call routing, intake assistance, transcription | OpenAI Realtime Voice |
| Document drafting / summarization | First-draft letters, summaries, redlines | OpenAI (under enterprise terms) |
| Search / retrieval | Search across firm documents and matter records | Internal + vendor models |
| Scheduling assist | Suggested meeting times, confirmations | Calendar + LLM |
| Voicemail and recording transcription | Speech-to-text for messages and meetings | OpenAI Realtime Voice |
3. Human review of legal advice
All legal advice, court filings, and substantive client communications are reviewed and approved by a licensed attorney before being delivered or filed. AI is a tool, not a lawyer. AI output may be incorrect, incomplete, or biased; lawyers do not rely on AI output without verification.
4. No legal-effect automated decisions
We do not make decisions producing legal or similarly significant effects about you based solely on automated processing. Where AI assists in decisions, a human reviews the decision before it is acted upon. This commitment is consistent with GDPR Article 22 for individuals to whom that law applies.
5. Data handling
- We use AI vendors under contracts that prohibit training their public models on our customer data.
- We use AI vendors that meet our security and confidentiality standards (HIPAA Business Associate Agreements where PHI is involved).
- We minimize the data sent to AI tools to what is needed for the task.
- Voice transcripts and AI outputs become part of the matter file and are retained per the Record Retention Policy.
6. Notice to callers and clients
When AI is used in a way you may interact with directly — for example, a voice assistant that takes intake calls or a chatbot on the Site — we provide notice in the interaction itself. You may at any time request to speak with a human.
6.1 Privileged conversations
Voice-AI features are not used for attorney-client privileged conversations unless the client has been informed and has consented. Where a privileged call is anticipated, voice-AI is disabled or the client is notified at the start of the call and asked to confirm consent on the record. Inadvertent capture of privileged content is treated as protected confidential information, segregated, and reviewed under RPC 1.6 and the firm's data-handling procedures.
7. Your choice
You may opt out of AI-assisted interaction by:
- selecting "human only" in your Portal preferences;
- replying with the word "human" in chat;
- pressing the operator option on a phone call;
- emailing info@simonattorneys.com.
Opting out may delay response times.
8. Cite-checking and hallucinations
AI tools can fabricate legal citations and authorities. SLG independently verifies any AI-generated citation before relying on it or filing it with a tribunal. (See Mata v. Avianca, Inc., 678 F. Supp. 3d 443 (S.D.N.Y. 2023).)
9. Risks
- Errors and "hallucinations": AI may produce confident-sounding but incorrect content.
- Bias: AI can reflect biases in training data.
- Privacy: AI requires data input; we minimize what is sent.
- Security: AI vendors are part of our supply chain and are subject to vendor management.
10. Future updates
As we adopt new AI features or change vendors, we update this Disclosure. Material changes are governed by the Terms Change Policy.
